Reforms to Address Corporate Misuse of the Fair Entitlements Guarantee Scheme


Under the Fair Entitlements Guarantee (FEG) scheme, the Australian Government provides financial assistance for certain unpaid employee entitlements to eligible employees who have lost their jobs due to the insolvency of their employers. It is a scheme of last resort to support redundant workers.

Costs of the FEG scheme have been increasing in part due to the adoption of certain practices by select employers and parties associated with them, resulting in cost shifting to the scheme and through it, to taxpayers.

To address these issues and ensure the FEG scheme remains viable, the Australian Government is consulting on options for targeted law reform to address corporate misuse of the FEG scheme and to improve the recovery of FEG payments.

A consultation paper is now available.

Interested parties are invited to make a submission by Friday, 16 June 2017.

Making a submission

While submissions may be lodged electronically or by post, electronic lodgment is preferred. For accessibility reasons, please submit responses sent via email in a Word or RTF format. An additional PDF version may also be submitted.

All information (including name and address details) contained in submissions will be made available to the public on the Department of Jobs and Small Business website unless you indicate that you would like all or part of the submission to remain in confidence. Automatically generated confidentiality statements in emails do not suffice for this purpose. Respondents who would like part of their submission to remain in confidence should provide this information marked as such in a separate attachment. Submissions made in confidence will not be published.

On 5 October 2017, the Government announced it would introduce new laws to prevent corporate misuse of the Australian Government’s Fair Entitlements Guarantee (FEG) scheme.
