Workers’ compensation reform

The Safety, Rehabilitation and Compensation Act 1988 (the SRC Act) covers injured Australian Government employees and employees of corporations that hold a self-insurer licence under the Act.

On 25 March 2015, the Minister for Employment introduced the Safety, Rehabilitation and Compensation Legislation (Improving the Comcare Scheme) Amendment Bill 2015 (Improving the Comcare Scheme bill) to amend the SRC Act.  The Improving the Comcare Scheme bill lapsed with the proroguing of Parliament on 16 April 2016.

The Government remains committed to reform of the Comcare scheme as demonstrated by the introduction of the Seafarers and Other Legislation Amendment Bill 2016 to Parliament which contains two amendments to the SRC Act:

  1. Align weekly compensation age cut-off provisions with the qualifying age for the Age Pension as set out in the Social Security Act 1991; and
  2. Align household and attendant care provisions with the minimum benchmarks for workplace accidents under the National Injury Insurance Scheme.
